By accessing or using the PermitArk platform at permitark.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and PermitArk LLC, a Florida limited liability company ("PermitArk LLC," "we," "us," or "our"). If you are using the Service on behalf of a business entity, you represent that you have authority to bind that entity, and "you" refers to that entity.
If you do not agree to these Terms in their entirety, you must not access or use the Service.
To use the Service you must: be at least 18 years of age; have legal capacity to enter a binding contract; be a United States resident or entity; and not be prohibited from receiving services under applicable US law.
The PermitArk platform is designed for EHS professionals, facility operators, environmental engineers, and environmental consulting firms operating in the United States. It is not intended for personal or consumer use.
PermitArk LLC may offer access to the Service or specific features on a "beta" or pre-release basis. Beta access is provided as-is, without any warranty or service level commitment. Beta features may be changed, restricted, or discontinued at any time without notice. PermitArk LLC is not liable for any loss, damage, or disruption arising from your use of beta features. Your continued use of a beta feature constitutes acceptance of these limitations.
Beta access is limited to pre-approved email addresses and is not transferable.
Access requires creating an account with accurate, current information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at [email protected] of any unauthorized access.
Professional plans permit multiple Team Members. The account owner is responsible for all actions taken by Team Members.
PermitArk LLC offers two subscription plans: Starter ($199/month or $1,990/year), which includes a defined number of facilities as specified at the time of purchase; and Professional ($399/month or $3,990/year), which includes a higher facility limit as specified at the time of purchase. Additional Facilities may be added at $49/month or $490/year per facility beyond your plan's included limit, on both Starter and Professional plans.
A 14-day free trial is available and requires a valid payment method. You will not be charged until the trial ends. Cancel before the trial ends and no charge applies.
Subscriptions auto-renew at the end of each billing period. All payments are processed by Stripe. Cancellation takes effect at the end of the current billing period — no partial refunds for unused time, except where required by applicable consumer protection law. Beta Users who subscribe after the beta period retain their committed discount pricing for the life of an active, uninterrupted subscription.
All subscription fees are non-refundable except where required by law or where PermitArk LLC has materially failed to provide core Service functionality for a period exceeding 72 consecutive hours. Price changes for existing subscribers require 30 days prior written notice.
If a payment fails, PermitArk LLC may attempt to recharge the payment method on file. If payment is not received within 7 days of the due date, PermitArk LLC may suspend access to the Service. Accounts suspended for non-payment for more than 30 days may be terminated and data deleted in accordance with Section 13.
The Service is licensed for your organization's internal environmental compliance management only. You agree not to:
You are solely responsible for the accuracy of all data you enter, including facility information and permit selections. See Section 8 for limitations on regulatory data accuracy.
The Service, including its software, interface design, pre-loaded regulatory data, and documentation, is owned by PermitArk LLC and protected by US and international intellectual property laws. You retain ownership of all User Content (data and documents you upload). You grant PermitArk LLC a limited, non-exclusive license to store and process your User Content solely to provide the Service. PermitArk LLC will not use your User Content to train AI models.
Pre-loaded regulatory deadline data is derived from publicly available federal regulations (CFR, USC). PermitArk LLC's selection, arrangement, verification, and presentation of this data constitutes original expression protected by copyright.
Feedback: If you provide suggestions, ideas, or feedback regarding the Service ("Feedback"), you hereby assign all rights in such Feedback to PermitArk LLC. PermitArk LLC may use Feedback for any purpose without compensation or attribution to you.
PermitArk LLC pre-loads deadline data derived from verified federal and state regulations. Each auto-generated deadline displays the specific CFR or statutory citation it is derived from. You acknowledge that:
The Service includes an automated regulatory monitoring scanner that uses AI to review regulatory sources for changes. AI-generated notifications are preliminary indicators requiring manual review. PermitArk LLC reviews detected changes before updating deadline data. AI permit type identification (where available) is labeled as AI-assisted and requires user confirmation before records are created. All deadline data associated with AI-identified permits comes from PermitArk LLC's verified database — never from AI-generated estimates.
The Service includes a Filing Reference Panel that consolidates facility-specific data — including permit numbers, chemical inventory, facility details, and past filing notes — into a single view accessible when a compliance deadline is approaching. The Filing Reference Panel is designed to assist users in locating and reviewing their own data before manually entering information into applicable federal or state regulatory portals.
You acknowledge and agree that: (a) the Filing Reference Panel displays only data you have entered into the Service and is subject to the accuracy and completeness of that data; (b) the Filing Reference Panel does not submit information to any regulatory authority on your behalf; (c) you are solely responsible for verifying all values displayed in the panel before entering them into any regulatory portal or filing system; (d) the Filing Reference Panel does not constitute regulatory compliance guidance, environmental consulting, or legal advice; and (e) PermitArk LLC is not responsible for any regulatory penalties, enforcement actions, fines, or other consequences arising from information entered into any regulatory portal regardless of whether that information was sourced from the Filing Reference Panel.
The Filing Reference Panel is available exclusively to Professional plan subscribers. Starter plan subscribers may upgrade to Professional at any time to access this feature. PermitArk LLC reserves the right to modify or discontinue this feature at any time.
THE SERVICE IS PROVIDED FOR INFORMATIONAL AND TRACKING PURPOSES ONLY. PERMITARK LLC DOES NOT PROVIDE LEGAL ADVICE, ENVIRONMENTAL CONSULTING, OR REGULATORY COMPLIANCE DETERMINATIONS. CONSULT A LICENSED ENVIRONMENTAL ATTORNEY FOR ADVICE SPECIFIC TO YOUR REGULATORY OBLIGATIONS.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. PERMITARK LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEADLINE DATA IS ACCURATE, COMPLETE, OR CURRENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERMITARK LLC IS NOT LIABLE FOR: INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS OR DATA; REGULATORY PENALTIES, FINES, OR ENFORCEMENT ACTIONS; OR COST OF SUBSTITUTE SERVICES. PERMITARK LLC'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF AMOUNTS PAID BY YOU IN THE PRIOR 12 MONTHS OR $500.
You agree to defend, indemnify, and hold harmless PermitArk LLC and its members, officers, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising from: your violation of these Terms; your User Content; your use of the Service in violation of law; your regulatory compliance decisions regardless of whether you relied on Service data; or any claim by a governmental authority arising from your use or non-use of the Service.
PermitArk LLC may suspend your account immediately — without termination — for suspected violations of these Terms, non-payment, or security risks. Suspension preserves your data while access is restricted. PermitArk LLC will notify you of suspension and provide a reasonable opportunity to cure the issue where legally permissible.
PermitArk LLC may terminate your account for material breach, continued non-payment following suspension, legal requirement, or conduct that poses ongoing risk to the Service or other users. Upon termination, your data is retained for 30 days for export, then permanently deleted. Cancellation by you takes effect at the end of the current billing period.
Sections 7, 8, 11, 12, 15, and 16 survive termination.
PermitArk LLC shall not be liable for any failure or delay in performance arising from causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, power outages, internet service provider failures, third-party infrastructure outages (including Vercel, Supabase, Cloudflare, GitHub, or Stripe), cyberattacks, or government actions. In such events, PermitArk LLC's obligations are suspended for the duration of the event.
These Terms are governed by the laws of the State of Florida without regard to conflict of law principles. Disputes not resolved informally within 30 days shall be resolved by binding arbitration under AAA Commercial Arbitration Rules in Florida. Either party may seek emergency injunctive relief in a court of competent jurisdiction. Class action and class-wide arbitration are waived to the extent permitted by law.
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and PermitArk LLC regarding the Service and supersede all prior agreements or understandings.
Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver: PermitArk LLC's failure to enforce any provision shall not constitute a waiver of its right to enforce that provision in the future.
Assignment: You may not assign your rights under these Terms without PermitArk LLC's prior written consent. PermitArk LLC may freely assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of its assets, with 30 days' notice to you.
Notices: Legal notices to PermitArk LLC must be sent to [email protected]. PermitArk LLC will send notices to the email address associated with your account.
Modifications: PermitArk LLC may modify these Terms at any time. Material changes will be communicated by email and within the Service at least 14 days before they take effect. Continued use after changes constitutes acceptance.
